1. FORMATION AND AGREEMENT

These Terms of Service (the “Terms”) constitute a legally binding agreement between you (the “Customer”) and House of Beardall (“we”, “us”, “our”) governing your access to and use of our website and the purchase of goods via our Shopify store.

By placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms in full.

 

2. ABOUT US

House of Beardall is a United Kingdom-based online retailer of furniture, lighting, home décor, and homeware products supplied by third-party manufacturers and suppliers.

All transactions are processed via our Shopify store.

3. DEFINITIONS AND INTERPRETATION

In these Terms:

  • “Goods” means any products offered for sale by us.

  • “Order” means your request to purchase Goods.

  • “Contract” means the legally binding agreement formed upon dispatch confirmation.

Headings are for convenience only and shall not affect interpretation.

4. ELIGIBILITY

You represent and warrant that:

  • You are at least 18 years of age;

  • All information provided is accurate, complete, and not misleading;

  • You are authorised to use the payment method submitted.

We reserve the right, without liability, to refuse or cancel any Order where reasonably necessary, including where fraud, error, or operational constraint is suspected.

5. PRODUCTS

We shall take reasonable care to ensure product descriptions and imagery are accurate. However:

  • Natural materials inherently vary in colour, grain, and texture;

  • All dimensions are approximate unless expressly stated otherwise;

  • Colour representation may vary due to device and lighting conditions;

  • Goods may be manufactured or supplied by third-party suppliers.

All descriptions are non-binding representations and shall not constitute warranties beyond those required by law.

We reserve the right to amend, suspend, or withdraw Goods without notice.

6. ORDERS AND CONTRACT FORMATION

Your Order constitutes an offer to purchase Goods.

No Contract shall be formed until we issue dispatch confirmation.

We reserve the right to reject or cancel Orders at any time prior to dispatch, including but not limited to circumstances involving:

  • Stock unavailability;

  • Pricing or listing errors;

  • Suspected fraudulent activity;

  • Delivery restrictions or operational limitations.

7. PRICING AND PAYMENT

All prices are stated in GBP (£) and include VAT where applicable unless expressly stated otherwise.

Payment is due at the time of order unless otherwise specified.

We utilise third-party payment processors and do not store full payment card details.

We reserve the right to correct pricing errors at any time prior to dispatch.

8. DELIVERY

Delivery is strictly limited to mainland United Kingdom.

All delivery dates are estimates only and are not guaranteed.

We shall not be liable for delays caused by third parties, including suppliers and couriers.

You are solely responsible for ensuring:

  • Accurate delivery information;

  • Adequate access for delivery of Goods;

  • Availability to receive delivery;

  • A safe environment for delivery operations.

Where delivery is unsuccessful due to absence, incorrect information, or access restrictions, re-delivery, storage, or return costs will be charged to the customer. A re-delivery fee will be required prior to any further delivery attempt.

Risk in the Goods shall pass to you upon delivery.

You acknowledge and accept that delivery of heavy or large Goods may present risk, and you shall ensure that children and pets are kept at a safe distance during delivery.

9. CANCELLATION

We may, at our sole discretion, accept cancellation requests prior to dispatch.

Orders for made-to-order, bespoke, supplier-allocated, or special-order Goods may not be cancelled once processing has commenced.

Any permitted refund shall be made to the original payment method.

Nothing in this clause affects your statutory rights.

10. RETURNS

Returns are governed exclusively by our Returns & Refunds Policy, which forms part of these Terms.

11. FAULTY GOODS

Where Goods are faulty, damaged, or not as described, we shall comply with our statutory obligations under applicable UK law and our Returns Policy.

12. THIRD-PARTY SUPPLIERS

You acknowledge that Goods are sourced from third-party suppliers and are not manufactured by us.

We shall remain your primary contractual point of contact in relation to all Orders.

13. LIMITATION OF LIABILITY

Nothing in these Terms shall exclude or limit liability for death or personal injury arising from negligence, fraud, or any liability which cannot be excluded by law.

Subject thereto, we shall not be liable for any indirect, consequential, or special loss, including but not limited to loss of profit, revenue, goodwill, or data.

14. FORCE MAJEURE

We shall not be liable for any failure or delay in performance arising from events beyond our reasonable control, including but not limited to supply chain disruption, courier delays, industrial action, or acts of nature.

15. PRIVACY

We process personal data in accordance with our Privacy Policy and applicable data protection legislation.

16. ENTIRE AGREEMENT

These Terms, together with any policies expressly incorporated herein, constitute the entire agreement between the parties and supersede all prior representations or agreements.

17. SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.

18. WAIVER

No failure or delay by us in exercising any right shall constitute a waiver of that right.

19. ASSIGNMENT

We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign your rights without our prior written consent.

20. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.

21. AMENDMENTS

We reserve the right to amend these Terms at any time. The version in force at the time of your order shall apply.
